Good Morning!!!







1.     Unlike Civilian Courts where the Judge determines the punishment, The Panel (think Jury) determines the punishment and the Judge confirms it or sends the Panel back to find a different punishment.
2.    Normally, the courts will hand out a discharge (Dishonorable/Bad Conduct) or refer you to a retention board which hands out Other than Honorable and sometimes Honorable Discharges.

 This Panel handed out a Huge Fuck You!

At a General Court-Martial in Washington, D.C., HM3 Mark A. Berger, USN, pled guilty to possession of a controlled substance and was tried for an assault consummated by a battery. On 20 December 2018, his guilty plea to possession of a controlled substance was accepted and members returned a verdict of guilty of assault consummated by a battery. Members sentenced him to reduction in rank to paygrade E-1, hard labor without confinement for 90 days, restriction for 60 days, and forfeiture of all pay and allowances until discharged from the service.

I’ve never heard of “forfeiture of all pay and allowances until discharged from the service.” Without a discharge!!!  The Panel Was Pissed!!!
